The mandatory consumer-protection provisions of the country in which the consumer has their habitual residence remain unaffected to the extent that they are more favourable to the consumer than the provisions set out below.

1) Scope of Application
1.1 These Terms & Conditions ("T&Cs") of AM GbR (civil-law partnership / Gesellschaft bürgerlichen Rechts), trading as "MedoMods" (the "Seller"), apply to all contracts for the sale of goods that a consumer or entrepreneur (the "Customer") concludes with the Seller via the Seller's online shop. Any terms of the Customer are rejected unless expressly agreed otherwise.
1.2 These T&Cs also apply to contracts for vouchers, unless expressly regulated otherwise.
1.3 A consumer is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business or profession. An entrepreneur is a natural or legal person or a partnership with legal capacity acting in exercise of its trade or profession.
2) Conclusion of Contract
2.1 Product presentations in the online shop are not binding offers; they invite the Customer to submit a binding offer.
2.2 By completing the checkout process and clicking the order button, the Customer submits a binding offer for the goods in the cart.
2.3 The Seller may accept the offer within five (5) days by:
(a) sending an order confirmation by e-mail (text form); or
(b) dispatching the goods; or
(c) requesting payment after order submission.
The contract is formed upon the first of these events. The acceptance period starts on the day after the Customer sends the offer and ends at the close of the fifth day. If the Seller does not accept within this period, the Customer is no longer bound.
2.4 After conclusion of contract, the Seller stores the contract text and sends it to the Customer by e-mail.
2.5 The Customer can identify and correct input errors before submitting the order using the usual browser/shop functions.
2.6 Contract language: German.
2.7 Order processing is usually automated by e-mail. The Customer must provide a correct e-mail address and configure spam filters to receive messages from the Seller.
3) Right of Withdrawal
3.1 Consumers generally have a statutory right of withdrawal.
3.2 Details are set out in the Seller's Cancellation Policy (provided separately in the shop). For consumers who have their habitual residence in another EU Member State, the mandatory minimum standards of the law of that Member State apply to the extent that they are more favourable to the consumer than the provisions set out here.
3.3 The right of withdrawal does not apply to consumers who, at the time of contract conclusion, are not resident in an EU Member State and whose sole residence and delivery address are outside the EU.
3.4 The right of withdrawal is excluded for the supply of goods made to the consumer's specifications or clearly personalised, such as custom watch builds or personalised dials (for example with logos or engravings), in accordance with Article 16(c) of Directive 2011/83/EU and § 312g(2) BGB. This exclusion is set out and communicated transparently in the Cancellation Policy together with the statutory withdrawal information.
4) Prices and Payment Terms
4.1 Unless stated otherwise on the product page, prices are total prices plus any shipping costs shown at checkout. VAT display follows the status shown at checkout (if § 19 German VAT Act applies, no VAT is shown).
4.2 For deliveries to non-EU countries, additional costs may arise (e.g., bank/FX fees, import duties/taxes/customs charges) payable by the Customer. Such costs may also arise when payment is made from outside the EU even if delivery is within the EU.
4.3 Payment methods: The methods displayed at checkout are available, in particular Stripe (credit/debit card, Apple Pay, Google Pay). Additional terms of the respective payment provider may apply.
5) Delivery and Shipping Conditions
5.1 Delivery is made within the delivery area indicated by the Seller to the shipping address specified by the Customer at checkout.
5.2 Origin & transit: Shipment regularly originates from Asia (non-EU) via international logistics partners (e.g., DHL, UPS, CTT, Correos, YunExpress). Peak seasons and customs processing may cause delays.
5.3 Transfer of risk:
For entrepreneurs, risk of accidental loss/deterioration passes upon handover to the carrier.
For consumers, risk passes upon handover to the consumer/an authorised recipient. Exception: if the consumer commissions the carrier and the Seller did not name that carrier, risk passes upon handover to that carrier.
5.4 Self-supply reservation: If the Seller is not supplied correctly or on time through no fault of the Seller despite a proper covering transaction, the Seller may withdraw. The Customer will be informed without delay; any consideration received will be refunded.
5.5 Self-collection is not available.
5.6 Vouchers, where offered, are provided by e-mail or post.
6) Retention of Title
Where the Seller performs in advance, the goods remain the property of the Seller until paid in full.
7) Liability for Defects (Warranty)
7.1 Statutory warranty rules apply unless modified below. Where the Customer is a consumer with habitual residence in another EU Member State, the mandatory statutory conformity and warranty rules of that Member State apply to the extent that they are more favourable to the consumer (for example, the statutory conformity guarantee and the rules on hidden defects under French law for consumers in France, or the statutory legal conformity guarantee of three years for new goods under Spanish law for consumers in Spain). Nothing in these T&Cs limits such mandatory consumer rights.
7.2 For entrepreneurs:
The Seller may choose the type of subsequent performance.
For new goods, the limitation period for defects is one (1) year from delivery.
For used goods, defect rights are excluded.
Replacement delivery does not restart the limitation period.
7.3 The above restrictions do not apply:
to claims for damages/reimbursement of expenses;
where the Seller fraudulently concealed a defect;
to goods normally used for a building and causing its defectiveness;
to any update obligation for goods with digital elements.
7.4 Statutory recourse claims of entrepreneurs remain unaffected.
7.5 Commercial duty to examine and notify: If the Customer is a merchant (§ 1 HGB), §§ 377 et seq. HGB apply.
7.6 Transport damage (consumers): Consumers are requested to report obvious transport damage to the carrier and notify the Seller. Failure to do so does not affect statutory/contractual rights.
8) Special Conditions for Processing Goods to the Customer's Specifications
8.1 If, in addition to delivery, the Seller owes processing to Customer specifications (e.g., personalised dials, full custom builds), the Customer must provide all necessary content (texts/images/graphics) in the required formats and with the necessary rights, and warrants that no third-party rights are infringed.
8.2 The Customer shall indemnify the Seller against third-party claims arising from rights infringements caused by the contractual use of the Customer's content (including necessary legal defence costs), where the Customer is at fault.
8.3 The Seller may reject orders if content violates laws/regulations or public policy (in particular unconstitutional, racist, discriminatory, insulting, harmful to minors, or glorifying violence).
9) Redemption of Promotional Vouchers
9.1 Free, time-limited promotional vouchers may be redeemed only in the online shop and only within the stated period.
9.2 Redeemable by consumers only.
9.3 Certain products may be excluded as stated on the voucher.
9.4 Redeemable only before checkout completion; no retrospective set-off.
9.5 Only one promotional voucher per order.
9.6 Basket value must at least equal the voucher amount; remaining balance is not refunded.
9.7 If the voucher does not cover the order total, the difference may be paid using other available methods.
9.8 No cash payment or interest on voucher balances.
9.9 If goods paid (in whole/part) with a promotional voucher are withdrawn, the voucher is not refunded.
9.10 Promotional vouchers are transferable; the Seller may perform with discharging effect to the holder redeeming it, except where the Seller knows or grossly negligently does not know that the holder lacks authority.
10) Redemption of Gift Vouchers
10.1 Gift vouchers purchased for value may be redeemed in the shop unless otherwise stated on the voucher.
10.2 Gift vouchers and remaining balances are redeemable until the end of the third calendar year after purchase. Remaining balances are credited until expiry.
10.3 Redeemable only before checkout completion; no retrospective set-off.
10.4 Multiple gift vouchers may be redeemed per order.
10.5 Gift vouchers cannot be used to purchase other gift vouchers.
10.6 If the voucher does not cover the order total, the difference may be paid using other available methods.
10.7 No cash payment or interest on voucher balances.
10.8 Gift vouchers are transferable; the Seller may perform with discharging effect to the holder redeeming it, except where the Seller knows or grossly negligently does not know that the holder lacks authority.
11) Applicable Law
11.1 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice applies only insofar as it does not deprive them of mandatory protections of the law of their habitual residence.
11.2 This choice of law does not apply to the statutory right of withdrawal for consumers who, at contract conclusion, are not residents of an EU Member State and whose sole residence and delivery address are outside the EU.
11.3 Place of jurisdiction (consumers): For disputes with consumers, the exclusive place of jurisdiction is the court of the consumer's place of residence or domicile where mandatory consumer-protection law of the consumer's EU Member State so provides. In particular, for consumers domiciled in Italy, the court of the consumer's place of residence or domicile has exclusive jurisdiction (foro del consumatore) in accordance with the Italian Consumer Code.
12) Alternative Dispute Resolution
12.1 We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle). In German: "Wir sind nicht bereit und nicht verpflichtet, an einem Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen."
12.2 The European Commission's Online Dispute Resolution (ODR) platform has been discontinued by the European Commission and is no longer available; no link to the platform is therefore provided.
12.3 Consumers in France: Consumers resident in France have the statutory right to free recourse to consumer mediation in accordance with Articles L.612-1 et seq. of the French Consumer Code (Code de la consommation) before bringing any dispute before the courts.
12.4 Consumers in Spain: Official complaint forms (hojas de reclamaciones) are available and can be requested from the Seller by e-mail at info@medomods.com.
